Terms and Conditions of Use of BD-API

These Terms and Conditions govern access to and use of the API, databases, query services, data updates, technical documentation, interfaces, reports, automated responses, and all other features provided by BD-API. Last updated: 9 June 2026.

BD-API is an internal-use information and data update tool. All information provided is for informational purposes only and does not constitute legal, regulatory, technical, chemical, medical, health, or professional advice. Any interpretation, application, or decision based on information obtained must be validated by a certified professional. Distribution, reproduction, assignment, resale, or publication of information provided by BD-API without express written authorisation is prohibited.

Acceptance

By accessing, subscribing to, integrating, querying, or using BD-API, the User declares to have read, understood, and fully accepted these Terms and Conditions.

1. Definitions

BD-API: trade name held by Gonzalez Gonzalez Martin (CUIT 20-32752436-5), Amenábar 3230, Buenos Aires, Argentina. API: the technology interface allowing structured information about cosmetic ingredients, substances, regulatory restrictions, normative updates, and related alerts to be queried or integrated. User: any natural or legal person who subscribes to, accesses, uses, or integrates the service. Information: any data, response, table, record, alert, report, or content delivered by BD-API. Certified Professional: a person with the qualifications, registration, or recognised competence to interpret and apply the applicable regulatory framework.

2. Scope of service

BD-API provides a technology service distributing data from the European Commission's CosIng database and related regulatory publications via API, for internal use in cosmetic product management systems. BD-API does not provide legal, regulatory, chemical, medical, toxicological, health, or compliance certification advice.

3. Permitted use

The User may use the API exclusively for internal queries, integration into proprietary systems, updating internal tables, and supporting internal processes of analysis, classification, control, documentation, or review, in accordance with these Terms and the contracted plan.

4. Internal use only

Unless prior express written authorisation is granted, information provided by the API shall be used solely for internal purposes. It is prohibited to resell, redistribute, publish, copy, reproduce, commercially exploit, incorporate into products or services for third parties, create competing services, allow unauthorised access, share credentials, or use scraping, bulk extraction, reverse engineering, or unauthorised methods.

5. Prohibition on unauthorised distribution

The User may not distribute, deliver, share, transfer, publish, commercialise, sublicence, rent, sell, copy, reproduce, export, or make available to third parties the information obtained via the API, including modified, enriched, adapted, consolidated, transformed, combined, or derivative versions.

6. Informational nature

All information provided is informational, referential, and for internal consultation purposes. It may originate from public, technical, regulatory, or documentary sources and may be subject to changes, errors, omissions, delays, or limitations of the original source. BD-API does not guarantee that it is complete, accurate, current, sufficient, binding, or fit for a specific purpose.

7. Mandatory professional interpretation

All information obtained via the API must be reviewed, interpreted, validated, and applied under the responsibility of a Certified Professional or competent person. BD-API shall not be liable for decisions made solely on the basis of information provided without professional review.

8. No professional advice

No data, alert, classification, result, report, or response generated by the API should be interpreted as a professional opinion, legal opinion, regulatory certification, product approval, compliance guarantee, medical, chemical, toxicological, or health recommendation, commercial authorisation, or substitute for professional review.

9. User responsibility

The User is solely responsible for use of the API, interpretation of information, decisions made, professional validation, regulatory compliance, system configuration, credential security, internal training, and verifying the currency, accuracy, and applicability of data.

10. Exclusion of liability

BD-API shall not be liable for errors, omissions, inaccuracies, outdated information, interpretation differences, regulatory changes, decisions by the User or third parties, losses, penalties, fines, regulatory rejections, User non-compliance, use without professional validation, technical failures, or acts of external sources. The User uses the API at their sole risk.

11. Service as-is

The API, information, and services are provided "as is" and subject to availability, without express or implied warranties of accuracy, completeness, currency, continuity, uninterrupted availability, freedom from errors, or fitness for a specific purpose.

12. Updates

BD-API may perform periodic, automatic, manual, or scheduled updates. A time gap may exist between a regulatory change and its reflection in the API. BD-API does not guarantee real-time updates.

13. Intellectual property

All rights to the API, platform, structure, technology, design, documentation, proprietary databases, models, code, architecture, trademarks, and interfaces belong to Gonzalez Gonzalez Martin (BD-API) or its licensors. Use of the service does not imply any assignment or transfer of intellectual property rights.

14. User data

The User retains ownership of data, queries, or proprietary information they upload or integrate, and represents that they hold the necessary rights and legal bases. BD-API may process such data to the extent necessary to provide the service, operate the API, comply with legal obligations, and maintain security.

15. Confidentiality

Both parties shall keep confidential all technical, commercial, operational, and contractual information exchanged. The User must prevent unauthorised access to the API, documentation, credentials, and results.

16. Security and credentials

The User is responsible for keys, tokens, passwords, endpoints, and integrations. Any use with their credentials shall be presumed to have been performed by the User. Security incidents must be reported promptly. BD-API may suspend access in the event of risk, breach, or suspicious activity.

17. Technical restrictions

The User may not exceed the limits of their contracted plan, affect the stability or security of the service, perform reverse engineering, scraping, crawling, or unauthorised bulk extraction, bypass authentication mechanisms, or use the API for unlawful or unauthorised activities.

18. Suspension or termination

BD-API may suspend, limit, or terminate access in the event of breach, unauthorised or abusive use, non-payment, unauthorised distribution, order by a competent authority, or technical, legal, or force-majeure reasons.

19. Indemnification

The User shall indemnify BD-API, its collaborators, and providers against claims, damages, penalties, losses, fines, costs, and obligations arising from misuse, incorrect interpretation, failure to obtain professional validation, regulatory non-compliance, or unauthorised redistribution of information.

20. Limitation of liability

To the maximum extent permitted by law, BD-API's total aggregate liability shall not exceed the amounts actually paid by the User during the three (3) months preceding the event giving rise to the claim. BD-API shall not be liable for indirect, special, incidental, punitive, consequential damages, or loss of profits, data, business opportunity, or reputation.

21. Modifications

BD-API may amend these Terms at any time, notifying by reasonable means (registered email or publication on the website). Continued use of the API after a modification is published shall constitute acceptance of the updated terms.

22. Assignment

The User may not assign, transfer, or sublicence rights or obligations without prior written authorisation. BD-API may assign or transfer the contract in connection with a reorganisation, asset sale, merger, acquisition, or business transfer.

23. Force majeure

BD-API shall not be liable for failures, delays, or interruptions resulting from events beyond its reasonable control, including internet failures, cyberattacks, power outages, governmental acts, natural disasters, third-party failures, or regulatory changes.

24. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Argentina. Any dispute shall be submitted to the ordinary courts of the Autonomous City of Buenos Aires, with waiver of any other jurisdiction that may apply.

25. Final acceptance

The User acknowledges that BD-API is an internal consultation tool, that the information does not replace professional intervention, that all final interpretation is the responsibility of a Certified Professional, that they will not redistribute the information without authorisation, and that they use the API at their own risk.
